Rules & Regulation For Opening New Sewa Kendra of Patanjali Ayurved Ltd.

 

Patanjali Ayurved Ltd. Office- D- 38, Industrial Area, Hardwar is a sole distributor of Business Undertaking Divya Pharmacy of Divya Yog Mandir (Trust) having its office at Maharishi Dayanand Gram, Delhi-Hardwar National Highway, Hardwar and a manufacturer of Ayurvedic Medicines, Food Products, Juices & Cosmetic items.

Patanajali Ayurved Ltd. will appoint its authorised Retailer/ Sewa Kendra on following terms and conditions :

1. The name of the shop will be kept “Patanjali Chikitsalya” & will be got registered with the Trade Tax Authority and if already registered, change the name in Trade Tax & Bank records.

2. The name & style of Sign Board of Patanjali Chikitshalya will be as per format provided by the P.A.L.. in soft copy at the time of Agreement between two parties.

3. It is necessary to acquire about 2000 sq. feet including 1000 sq. feet constructed area and furnish it in accordance with the Model of Interior Decoration given by the P.A.L. for establishing Patanjali Chikitshalya.

4. The Retailer will not make available any product for sale other than the products of P.A.L. or products permitted to sale by the P.A.L. at Chikitsalya mentioned in clause (2)

5. All the goods will be supplied to the Retailer against D.Ds. favouring  "Patanjali Ayurved Ltd." payable at Haridwar & received in advance.

6. The supply of the goods will be at F.O.R. (Destination).

7. An Inspector authorized by the P.A.L. will have right to inspect the premises of the Retailer as and when required by the P.A.L.

8. The Retailer will deposit a  sum of Rs. 1,00,000/- (Rupees One Lac Only) as a security with P.A.L. through a D.D. in favour of Patanjali Ayurved Ltd. payable at Hardwar. The allottee of Patanjali Chikitshalya must purchase first lot of medicines and herbal products worth of Rs. 7,50,000/- (Seven Lac & Fifty Thousand Only).

9. The expiry of medicines or other products or material of substandard quality will be replaced or settled by P.A.L.

10. The Trade discount to the Retailer will be given as under :           

    a.  On Medicines 20% on M.R.P.           

    b.  On Food Products 20% on M.R.P.            

    c.  On Cosmetic Items 20% on M.R.P.

11. The Retailer shall not sell any product at more than M.R.P.

12. The Retailer will maintain its books of A/c properly as per law.

13. The Retailer shall not sell these products for further sale, expect to the branches which are permitted in writing by the P.A.L.
14. The expenses for advertising at local level will be borne by the Retailer & at National level by the P.A.L.
15. In case of violation of any term/condition, the P.A.L. will have a right to cancel the Retailership without serving any notice in advance.
16. First an agreement will be signed between two parties, initially for the duration of 3 yrs. and further renewable for the succeeding terms.

         If anyone desires to become the Retailer/ open a new Sewa Kendra of Patanjali Ayurved Ltd. may apply to C.M.D., Patanjali Ayurved Ltd., D- 38, Industrial Area, Hardwar on plane paper along with following documents:

1. Location of shop, where one intends to open Sewa Kendra.
2. Photo of shop, where one intends to open Sewa Kendra.
3. Population of city, where one desires to open Sewa Kendra. Also state whether any other Sewa Kendra of P.A.L. is already in the same city, if yes, then how many kilometers away from your shop.
4. Xerox copy of statement of bank account of last three months.

DO'S AND DON'TS                  NECESSARY ITEMS FOR SHIVIR

The O&I are not subject or liable to change the structure of the Yog Shivir to suit individual needs. Not all presentations at the Yog Shivir may be suitable for everyone. If pain is experienced anytime during the practice of Yog, it should be stopped immediately and a qualified health care professional should be consulted. The O&I assume no responsibility and will not be liable for any harm, injury or damage resulting from any tort, negligence or from a breach of an express or implied warranty however caused or occurring during or after participation in the Yog Shivir or while practicing anything presented therein. By participating in the Yog Shivir the participant, for himself/herself, his/her heirs, and assigns, hereby expressly assumes all risks, full responsibility and liability for participating and practicing anything presented therein and forever waives and releases and agrees to defend, indemnify and hold the O&I harmless from and against any and all claims or demands, liabilities and settlements (including without limitation, legal and accounting fees) on or against the O&I for losses or damages, including, without limitation, direct,indirect, incidental, consequential or special damages, personal injury/wrongful death, resulting from or alleged to result from participating in or practicing anything that is presented in the Yog Shivir. The O&I, at their sole own discretion reserve the right to deny participation at any time of the Yog Shivir to any entity without assigning any reason whatsoever.
